Terms of Service

By creating an account or purchasing hosting from Fus1onW3b ("the Service"), operated by Fus1on Studios ("we," "us," "our"), you agree to these Terms of Service. If you don't agree, don't use the Service.

Fus1onW3b provides shared static + PHP website hosting, provisioned automatically into an isolated container per site. Depending on your plan this can include SFTP access, automated backups, a one-click app catalog, custom domain support, Git-push deployment, uptime monitoring with a public status page, team collaboration, and email hosting.

Signing in uses a Fus1on Studios account (OIDC) as your root identity - there is no separate password for this site. You may optionally link a Discord account from Settings; Discord alone can never create or sign into an account that hasn't already opted in. You're responsible for anything that happens under your account.

Plans are billed monthly through Stripe. You can upgrade, downgrade, or cancel at any time from /dashboard/billing - plan changes prorate automatically, and cancellation stops future billing but does not retroactively refund the current billing period except at our discretion on a case-by-case basis. Add-ons (a fus1on.host subdomain, extra email mailboxes) are separate recurring line items on the same subscription and can be adjusted independently of your plan.

You may not use the Service to:

• Host illegal content, malware, or phishing infrastructure.
• Send unsolicited bulk email (spam) through the email hosting feature.
• Attempt to access another tenant's site, files, or container.
• Deliberately exceed your plan's resource limits in a way intended to disrupt shared infrastructure.
• Resell hosting service without our prior written agreement.

Violating this section may result in suspension or termination without refund.

You retain full ownership of the files, code, and content you upload or deploy to your site. We don't claim any rights to it, and we don't access it except as needed to operate the Service (backups, support you request, or investigating a suspected Acceptable Use violation).

The Service relies on third-party providers to operate: Fus1on Studios (account identity), Stripe (payment processing), Cloudflare (traffic routing and, for email hosting, inbound mail routing), Resend (outbound email delivery), and Discord (optional account linking). Your use of the Service is also subject to those providers' own terms where applicable.

The Fus1onW3b name, branding, and the underlying platform software are owned by Fus1on Studios. These Terms don't grant you any rights to them beyond what's needed to use the Service itself.

We may suspend or terminate your access for violating these Terms, non-payment, or extended account inactivity, with notice where practical. On deprovisioning, your site's files are retained for a grace period before permanent deletion - not deleted automatically the moment service ends. You may cancel and stop using the Service at any time.

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, Fus1on Studios is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including data loss - back up anything you can't afford to lose, in addition to using the Service's own backup feature.

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above; continued use of the Service after a change constitutes acceptance of it.

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles.
